In criminal court proceedings, the children are required to testify, (I have been involved in multiple cases and did research papers on this topic) and be able to hold up in cross examination. The courts are very tough on kids in general, but in the cases where a child with a disability is involved, it is virtually impossible to seek harsh penalties for child abuse where a child has a disability. <br /><br />I work with a child now (have guardianship of him) who has microcephalic primordial dwarfism (MOPD2) who was severely abused physically as well as emotionally (locked in a dog cage and beat on) and the sentence was only 4th degree DV assault and a 220 day sentence. The logic the judge used is this child cannot testify, a requirement of the criminal judicial system where the only sentence possible is a misdemeanor assault charge which is outside the child abuse area of criminal law even though body cam video is present where police went in to find the child. <br /><br />Colinhttps://www.blogger.com/profile/09471958774039208523noreply@blogger.com
